Funny, I got some pho to go around 1:45 yesterday, and the place was indeed ABSOLUTELY PACKED and people were still pouring in. I ordered to-go (as I almost always do) and Spike asked if I was sure, said that even though they were technically closing at 2:00, they planned to serve everyone who came in and I was welcome to have a seat and dine in. I was a little surprised, when I saw the sign on the door I was a little afraid they'd be annoyed, but not at all.

Also, side note, I've had the banh mi now a few times, and it's pretty good. My main complaint is that they actually put too much meat in it, which is probably a silly thing to complain about, but I prefer a more balanced amount of meat and veg.
